Trustee Jamerson moved to approve the minutes from the August 18, 2020 Public Hearing. Trustee Clayton seconded the motion. The motion passed by the following vote:

Director of Community Services Report

Acting Director of Community Services Russ Kraly reported the monthly permit, inspection and income report was distributed for July and August.

Plan Commission Report

Mr. Huvard reported the Plan Commission will meet on Thursday.

Village Attorney’s Report

Mr. Huvard reported the Village is not in a position to approve the Bond Ordinance or the Street Maintenance bid. A resident on Kingswood has friends in the business and believes they can get bids lower than the Village received. They may want to proceed privately getting bonds. Mr. Huvard suggested waiting until the second meeting in September to determine whether to proceed. Trustee Haber asked how the Village would recover the cost if they do not move forward. Mr. Huvard explained the Village could levy a tax to the SSA to recoup the costs. They could also implement an annual maintenance levy. Trustee Haber suggested taking a deposit for the preliminary work, so the Village does not incur the costs in the future. Mr. Glenn noted Kingswood is the biggest piece in the Street Maintenance contract. If the Kingswood portion is removed, the Village cannot expect Chicagoland Paving to honor the prices.

Police Report

Chief Dayno noted the police activity report is attached to the end of the minutes.

Information Items and Comments from the President

1. Mayor Norris will attend the September 15, 2020 Board of Trustees meeting remotely. The Village Clerk will be at the Village Hall.

2. Street Light List
Trustee Jamerson noted the list shows which street lights are maintained and paid for by the Village. He noted the street light by Village Hall is a high-pressure sodium light and is maintained by ComEd. Trustee Jamerson noted most of the street lights are at intersections of public roads. He asked why the street light at the intersection of Hoffman Lane and Deerfield Road is paid for by the Village while other intersections are not. There are many intersections that are dark at night. If the Village wants more street lights, they would have to go to the new business desk at ComEd. Trustee Jamerson will send the Trustees review the list of street light locations along with a map showing the locations.

New Business

Discussion and Possible Approval of Path Remediation Plan and Contracts

The Trustees have discussed the condition of the various paths around the Village for several months. The Village Engineer had condition surveys performed and reports have been prepared. The Road and Bike Path Committee met to review the reports and agreed on a basic maintenance plan and recommendations for repairs.

Mayor Norris noted they reviewed Riverwoods Road for safety and maintenance and Deerfield Road for safety, as Deerfield Road is scheduled to be replaced. Mr. Glenn suggested authorizing up to $5000 so additional work could be completed. Mayor Norris indicated the Village used to remove the snow on the Riverwoods Road paths many years ago, and Trustee Chamberlain added that we have also done so within the last few years. He will speak with the snow removal company to determine the cost to remove snow from the path.

The Trustees discussed:
-That the path along Riverwoods will not get replaced with the widening of Deerfield Road
-Whether the engineering costs to design a new path along Riverwoods Road could be paid by MFT funds
-Engineering costs are MFT eligible, but must go through IDOT. The Village is saving up the MFT funds for the resurfacing of Saunders Road in 2023, as it will be a $700,000 project.
-Additional grants may be available for shovel-ready projects
-Whether to have projects shovel-ready even if a grant may not be received
-The Village spend some of the MFT funds on the engineering so if a grant becomes available, the path could be rebuilt properly
-Grants are not available for paths less than 10 feet wide.

-Whether the Saunders Road engineering should be completed now.
-Whether several projects could be bundled together, such as a path to the Campus, a path to the restoration area from the police station, etc., for MFT approval.

Trustee Haber moved to authorize up to $5000 for repairs to the safety path. Trustee Clayton seconded the motion. The motion passed by the following vote:

Presentation of 2020 Street Maintenance Bid Results and Approval of Recommended Bid

The 2020 Street Maintenance project involves reconstruction of Kingswood Court (SSA 34) and patching on other Village and private streets (SSA 26). The Village distributed eight (8) sets of plans and specifications and received six (6) bids ranging from $115,000 to $158,788. The engineer’s estimate was $116,222.25. The low bid was received from Chicagoland Paving Company.

Mr. Glenn suggested holding this over to the next meeting, based on the prior conversation.

An Ordinance Amending the Riverwoods Village Code Regarding the Regulation of Cannabis

The Cannabis Regulation and Tax Act legalized consumption of certain quantities of cannabis in some settings but retains certain penalties. Mr. Huvard and Chief Dayno have reviewed and recommended changes to a number of provisions in the Village Code that have become out of date given the new law. The amendments are designed to bring our local Code into compliance with the State law. While the new law preempts home rule generally, it does allow for local Ordinance violations that track certain of the infractions under state law.

Trustee Hollander asked how to determine if one is under the influence. Chief Dayno noted there are some eye tests and field sobriety tests that can be done. If someone appears to be impaired and is not doing well in these tests, they would be asked for a blood and/or urine test.

Trustee Jamerson moved for First Reading of the Ordinance amending the Riverwoods Village Code regarding the regulation of cannabis. Trustee Hollander seconded the motion. The motion passed by the following vote:

AYES: Chamberlain, Clayton, Goldstein, Haber, Hollander, Jamerson (6)
NAYS: None (0)

Ordinance Providing for the Issue of $120,000 Special Service Area 34 Special Tax Bonds, Series 2020 of the Village of Riverwoods, Lake County, Illinois, and the Levy of a Direct Annual Tax Sufficient to Pay the Principal and Interest of Said Bonds

Mayor Norris noted this agenda item will be continued, based on the previous conversation.

Ordinance Prohibiting the Use of Groundwater as a Potable Water Supply by the Installation or Use of Potable Water Supply Wells or by Any Other Method

This will be continued to the next Board of Trustees meeting.

Approval of Severance Agreement with Robert Durning

Trustee Hollander moved to approve the Severance Agreement with Robert Durning. Trustee Clayton seconded the motion. The motion passed by the following vote:

Standing Committee Reports

Budget and Woodland Management – Trustee Chamberlain reported Ryan Schultz forwarded brand-consistent backgrounds for the digital sign and the color guide that is a part of the branding guide we already have. The Branding and Education Committee will meet again on Friday. The Trustees discussed the electric sign messaging and believe there should be a messaging plan. Mayor Norris and Chief Dayno are working on a list of standardized messages for road closures and standing water. The Branding and Education Committee could work on a policy or guidelines for messaging. Some of the intended messaging may incorporate the Social Media plan as well. The guidelines will be brought to the Trustees.

Police and Building – Trustee Jamerson reported the development of the Flatwood Plan is going well, but there are supply chain challenges due to Covid. The concrete has been poured for the patio, the curbs have been poured for the parking lot and it is ready for asphalt. Trustee Jamerson does not believe it will be ready for Halloween. He will provide a full update to the Board at the next meeting. Trustee Haber suggested trying to find a way to have a virtual Halloween Party. Mayor Norris and Clerk Paras have been working on a Halloween solution.

Roads & Land Use – Trustee Hollander noted it has been several years since the Board reported on the wells in the Village. He believes the Village should get a report on the health of the wells at least once a year. Trustee Jamerson noted the Village used to get readings from some residential wells.

Economic Development, Finance & Capital Planning – Trustee Clayton noted the next step for the taxation hearing is to put together a time table. He will work with Nathan and Mr. Huvard on putting something together.

Good of the Order

On behalf of the Village staff and Trustees, Mayor Norris wished everyone a Happy Labor Day.
