Board of Trustees Meeting

February 18, 2020

Call to Order:  7:30 pm

Approval of Minutes

Trustee Chamberlain moved to approve the minutes from the February 4, 2020 Board of Trustees meeting.  Trustee Clayton seconded the motion. The motion passed unanimously on a voice vote.

 

Treasurer’s Report

Mayor Norris noted today was Bob Fialkowski’s last day.

 

Plan Commission Report

Mr. Huvard reported the Plan Commission discussed the definition of a family.  They will meet again in March.

 

Police Report

Chief Dayno noted the police activity report is attached to the end of the minutes.  There is a criminal sexual assault report from a person that was 10 years old in 1989.  He heard the State had lifted the statute of limitations for that type of crime.  Chief Dayno contacted the State’s Attorney and found the statute cannot be enacted retroactively so it cannot be investigated.

 

Information Items and Comments from the President

  1. Public Usage of Village Meeting Spaces.

Mayor Norris is close to completing a final version of regulations for using Village Hall spaces.  The Village has received several requests to use Village spaces

  1. Budget and Finance Workshop – March 3, 2020 at 6:00 pm

Mayor Norris noted the Trustees will meet at 5:30 pm rather than 6:00 pm.

Approval of Bills

Trustee Clayton moved to approve the bills.  Trustee Chamberlain seconded the motion.  The motion passed by the following vote:

AYES:  Chamberlain, Clayton, Goldstein, Hollander, Jamerson (5)

NAYS:  None (0)

 

New Business

  1. Discussion and Possible Approval of Redevelopment Agreement with GMX Real Estate Group for TIF Property on the Southeast Corner of Milwaukee and Deerfield

Mr. Huvard has been working with GMX Real Estate Group, who sent the Village a Letter of Intent to develop a Thorntons gas station and convenience store.  The Village is trying to figure out the timeline that the County will be working on Deerfield Road as the project needs to be completed before the road widening.  Thorntons cannot open with the current, limited access points and is looking for an incentive from the Village to open earlier than four years from now.  The Village would lose projected sales revenue if they waited for the County to complete their work on Deerfield Road.  If Thorntons waited for the County, the access work would be completed.

Lake County DOT would consider Thorntons’ requests if an engineering study showed the necessary improvements for new access points could be accomplished without interfering with the Deerfield Road expansion.  Mr. Huvard indicated Cubesmart and Thorntons would become a PUD.

Andrew Goodman and Paul Takacs, Principals with GMX Real Estate Group, and Mike Ruczuki, Real Estate Manager with Thorntons were present.  Mr. Goodman proposes constructing a Thorntons gas station with 10 gas pumps and a 24-hour, 5000 square foot convenience store.  In order to make the site function, they need to update the right-in, right-out access on both Deerfield Road and Milwaukee to be full accessways.  The accessways are imperative to their operation.

The Trustees discussed diesel fuel.  Mr. Goodman explained they do not want to tie up a bay for diesel at this time, as it is not a smart business move.  The RFP mentioned the willingness to construct an attractive landscape retaining wall for detention or a corner landscaping element as aesthetics are important to Riverwoods residents.  Mr. Goodman is trying to balance their operations desire to have the gas islands close to the corner with the Village’s desire for upgraded landscaping.  He offered to meet with neighbors to gather their input early on and try to incorporate what the can.  The Trustees discussed the parking requirements, as there are currently 25 spots shown.  The parking is for the convenience store.  The Trustees expressed concern about potential cut-thru traffic.  Mayor Norris noted it is an enforcement issue. They questioned whether there is a cross access agreement with Cubesmart.  The Village will speak with representatives from Cubesmart about cut-thru traffic.

Mr. Huvard questioned what would be needed to bring back a more refined proposal.

 

  1. Ordinance 20-02-03 Amending Ordinance Number 13-12-30, Which Established Village of Riverwoods Special Service Area 27, to Correct the Special Tax Roll Following A Lot Subdivision

Mr. Huvard reported in 2019, the Trustees approved a boundary adjustment between two adjoining lots.  Although the area and boundary of the SSA are not changing, there are now two PINs and two lots where there was previously one.

Trustee Chamberlain moved to waive First Reading of the Ordinance.  Trustee Jamerson seconded the motion.  The motion passed unanimously on a voice vote.

Trustee Chamberlain moved for Second Reading and adoption of the Ordinance.  Trustee Jamerson seconded the motion.  The motion passed by the following vote:

AYES:  Chamberlain, Clayton, Goldstein, Hollander, Jamerson (5)

NAYS:  None (0)

 

Old Business

  1. Ordinance 20-02-04 Adopting Provisions in the Village Code Regarding Reimbursement to the Village of Consultant Fees

Mr. Huvard discussed the changes since the last Board of Trustees meeting.  He noted the Director of Community Development should follow the schedule when fees are indicated.  The exception is where there is a project with an unusual scope, the petitioner could ask for a review of the fees.

Trustee Chamberlain moved for Second Reading and Adoption of the Ordinance.  Trustee Clayton seconded the motion.  The motion passed by the following vote:

AYES:  Chamberlain, Clayton, Goldstein, Hollander, Jamerson (5)

NAYS:  None (0)

 

Good of the Order

Trustee Chamberlain reminded the Trustees and residents to attend the Wine and Cheese event on Thursday, February 27that 5:00 pm.  It will be a fun event.

 

Adjournment

There being no further business to discuss, Trustee Clayton moved to adjourn the meeting.  Trustee Chamberlain seconded the motion.  The meeting was adjourned at 8:15 pm.

The next regular meeting of the Board of Trustees will take place on March 3, 2020 at 7:30 pm.  The Committee of the Whole meeting to discuss budget and finance will be held at 5:30 pm.
